Simon & Schuster said on Thursday that it would cancel the publication of an upcoming book by Senator Josh Hawley, one of several members of Congress who tried to overturn the results of the presidential election.
Mr. Hawley, a Missouri Republican and Trump ally, has been criticized for challenging the results and accused of helping incite the mob that stormed the Capitol on Wednesday. His book, “The Tyranny of Big Tech,” was scheduled to be published in June.
“We did not come to this decision lightly,” Simon & Schuster said in a statement. “As a publisher it will always be our mission to amplify a variety of voices and viewpoints: At the same time we take seriously our larger public responsibility as citizens, and cannot support Senator Hawley after his role in what became a dangerous threat.”
In a statement posted to Twitter, Mr. Hawley said that the cancellation of his book was an affront to the First Amendment.
“This could not be more Orwellian,” he said. “Simon & Schuster is canceling my contract because I was representing my constituents, leading a debate on the Senate floor on voter integrity, which they have now decided to redefine as sedition.”
Mr. Hawley added: “We’ll see you in court.” In a subsequent statement, Simon & Schuster said it was confident it was acting within its contractual rights. ...

The acting US Attorney for the District of Columbia, Michael Sherwin, confirmed Thursday that his office is investigating potential criminal charges against "all actors here and anyone that had a role" in the storming of the US Capitol on Wednesday by a violent mob. Importantly, Sherwin vowed that "if the evidence fits the elements of a crime here, they're going to be charged."
This is exactly what prosecutors must do: Gather the evidence, impartially assess the law, and, if appropriate, bring criminal charges against anyone who had any role in the crime -- even if one of those people is the President (or, soon, former President) of the United States.
Indeed, there is a criminal case to be made against President Donald Trump for his role in the assault on the Capitol. It's not an easy case or an automatic win for prosecutors. But there is a legitimate case there for any prosecutor with the fortitude to bring it — and the ability to counter the defenses Trump's legal team may use to fight back. ... First, it is a federal crime to incite a riot -- defined as a "public disturbance" involving an act of violence by at least one person in a gathering of three or more people resulting in damage to property or physical injury. There's no question the people who physically breached the Capitol meet the definition of "rioting," and then some. The only question is whether Trump "incited" them. ... Second, a series of federal laws makes it a crime to commit illegal acts on the Capitol grounds, to enter restricted federal government buildings without authorization, and to destroy federal property. It's beyond dispute that the pro-Trump rioters smashed these laws. The only question is whether Trump bears any legal responsibility. ... Third, there's sedition. That's a dramatic word, but the specific definition of seditious conspiracy under federal criminal law is fairly straightforward: to "conspire to overthrow, put down, or to destroy by force the Government of the United States... or by force to seize, take, or possess any property of the United States contrary to the authority thereof." I'd focus on the latter provision here. No need to prove intent to topple the entire government -- though there's an argument along these lines -- so long as the prosecutor can demonstrate that the intent was to take control of a federal building without permission. There's no dispute this is precisely what the rioters did, just moments after Trump instructed them to "walk down to the Capitol" and "show strength." ...

The man photographed sitting at House Speaker Nancy Pelosi's desk during Wednesday's riots in the US Capitol has been arrested and charged with three federal counts, including theft of public property, federal officials said Friday.
Federal officials said Richard Barnett of Arkansas was taken into custody Friday morning in Little Rock.
Barnett was charged with knowingly entering and remaining in restricted building grounds without authority, violent entry and disorderly conduct on Capitol grounds as well as the theft of public property, officials said.
A resident of Alabama was also charged in connection with the pipe bomb found on the south side of the Capitol building. Eleven Molotov cocktails and military-style weapon were found in his pickup truck, officials said. ...

Anti-Trump group Lincoln Project also plans to target companies that support politicians voting against election results.
Marriott, the world’s largest hotel chain, said last week’s chaos at the Capitol caused the company to halt campaign donations to U.S. senators and representatives who voted against certifying the electoral college results of President-elect Biden’s win — a fresh sign of corporate America’s uneasiness with the violent attacks inspired by President Trump’s words.
The Blue Cross Blue Shield Association said it would do the same. The provider of health insurance to more than 100 million people said in a statement that its political action committee was suspending contributions “to those lawmakers who voted to undermine our democracy.”
Commerce Bank also said in a statement its political action committee has “suspended all support for officials who have impeded the peaceful transfer of power.” It has bank branches in five states, mostly in the Midwest. ... “These corporations are doing something very new, and something that could potentially alienate an important base for them,” said Craig Holman, government affairs lobbyist for Public Citizen, a money-in-politics group. The CEO of a Chicago company said he was arrested after breaching the US Capitol during Wednesday's Trump-fueled insurrection in Washington, DC.
Brad Rukstales, CEO of the marketing technology firm Cogensia, apologized for what he called a "moment of extremely poor judgment."
"It was the single worst personal decision of my life," Rukstales said in a statement posted on Twitter. ... "My decision to enter the Capitol was wrong, and I am deeply regretful to have done so," he said.
A number of other people present at Wednesday's unrest have faced consequences from their employers. Navistar, a direct marketing company in Maryland, fired an employee who was photographed wearing his company ID badge inside the US Capitol building.
"While we support all employees' right to peaceful, lawful exercise of free speech, any employee demonstrating dangerous conduct that endangers the health and safety of others will no longer have an employment opportunity with Navistar Direct Marketing," the company said in a statement provided to CNN.

Tonight I heard that the police did finally say to let them in. Whether that was because they saw weapons or just knew they had to fallback or too many people were going to be hurt.

After months of stoking anger about alleged election fraud, one of America’s largest talk-radio companies has decided on an abrupt change of direction.
Cumulus Media, which employs some of the most popular right-leaning talk-radio hosts in the United States, has told its on-air personalities to stop suggesting that the election was stolen from President Trump — or else face termination. A Cumulus executive issued the directive on Wednesday, just as Congress met to certify Joe Biden’s election victory and an angry mob of Trump supporters marched on the Capitol, overwhelmed police and briefly occupied the building, terrorizing lawmakers and leading to the deaths of five people.
“We need to help induce national calm NOW,” Brian Philips, executive vice president of content for Cumulus, wrote in an internal memo, which was first reported by Inside Music Media. The New York State Bar Association will consider expelling President Trump's personal lawyer Rudolph W. Giuliani, and a state lawmaker is seeking his disbarment after inflammatory comments during a rally preceding last week's deadly riot inside the U.S. Capitol. ... In a statement Monday, the bar association said it has received “hundreds of complaints in recent months” about the former New York mayor and his failed bid to help Trump overturn his loss to Joe Biden.

Loews Hotels said on Saturday that it would not host a fund-raiser with Senator Josh Hawley of Missouri, the latest indication that many companies are distancing themselves from Republicans who voted to overturn the election results.
Fighting for Missouri, a political action committee affiliated with Mr. Hawley, had planned to host a “fun-filled, family-friendly Orlando weekend event” with the senator at the Loews Portofino Bay Hotel in Orlando, Fla., from Feb. 12 to Feb. 15, according to an invitation for the event. Tickets were being sold for $1,000 to $5,000, depending on the size of the group.
But Loews said that the fund-raiser had been called off after the deadly riot on the Capitol, which many Democrats and Republicans have blamed in part on Mr. Hawley and other members of his party who supported President Trump’s efforts to stop the certification of Joseph R. Biden Jr.’s victory.
“We are horrified and opposed to the events at the Capitol and all who supported and incited the actions,” the company said on Twitter. “In light of those events and for the safety of our guests and team members, we have informed the host of the Feb. fund-raiser that it will no longer be held at Loews Hotels.” ...
