Not the problem HB, the problem is the Senate wasn't in recess. Even the Obama Administration previously argued - before The Supreme Court - the Senate must be in recess 4 days or more to recess appoint.

So once again, Obama is making it up as he goes along. A big deal? Not really, next time we have a GOP President, based on the Obama precedent, he will be able to recess appoint if the Senate does nothing more than leave for the weekend. No sniveling out of you.

Article I, Section 5 provision in the Constitution that

Since the House never granted permission for the Senate to adjourn for more than 3 days, the Senate did not adjourn for more than 3 days.

Further, despite the Whitehouse dimwits assurances to the contrary, the CR shows quite clearly that business was conducted. The Payroll Tax extension was passed by the Senate on 12/23 during one of the sessions these num-nutts are now claiming were actually a recess.

These clowns really are almost too dumb to breathe.
