Arizona Jury Refuses to Enforce Republican Immigration Laws

Originally the long walks across the desert were basically our walls. It was near impossible to cross the area with no water etc. and more difficult to carry enough water to survive such a trek. Leaving water in the desert isn’t new, and the humanitarians certainly have a point about all people have a fundamental right to life.

We now have better vehicles, closer towns or civilization near the borders as well as better survival methods. This is resulting in shorter times to discover trespassers and higher probabilities of actually living through the ordeal.

60 minutes did a piece Sunday that said that the new border crossers are now seeking out border patrol, a change from before. The instinct to flee for your life. Or family cannot be legislated away.

Perhaps we really need a DMZ with walls on both sides. A sort of no man’s land? But only if we believe that immigration is something we need to treat as a threat and not an opportunity.

Strictly speaking, this was not a case of jury nullification because the defendant was not acquitted. It may be a case of the application of the defense of necessity or lesser evil defense, especially with respect to leaving the water bottles in the desert.

Jury nullification didn’t occur to me, but that might have been interesting. I don’t see a good answer, although I read someone saying, perhaps graham, saying to be effective the border wall would need to be on Mexico’s land such that crossing didn’t immediately put someone on US soil.

Same reason people can’t see that passing laws against abortion won’t stop abortions or passing laws against drugs won’t stop drug use.

I just noticed from Gus's post above the jury was made up of eight women and four men. Did the vote break down by gender? I'd be curious to know.

At the very least, that would make it unlikely that the government would put him on trial again. Probably they will drop it and think long and hard about bringing charges in similar cases.

Agree. It wasn't just a lone holdout. In fact, it was approaching being a lone holdout on acquitting him outright. Very gratifying to see -- and in Arizona for crying out loud.

Sort of, but Tucson is blue, along with Flagstaff, and the native american sections, but most of Arizona is red, and in some places radically red.
